Credit card offenses include theft, forgery, falsification and wrongful possession of other people’s credit cards with intent to commit fraud. The offences are punishable by imprisonment and/or a fine. According to section 342(1) of the Criminal Code of Canada, “every one who steals a credit card, forges or falsifies a credit card, uses or traffics in a credit card or a forged or falsified credit card, or uses a revoked or cancelled credit card is guilty of an indictable offence and is liable to imprisonment or punishable on a summary conviction.”

As thousands of unwitting victims lose hundreds of millions of dollars every year, a credit card offense is considered a serious crime. It is placed in the same category as theft, fraud, robbery and extortion as a “crime of dishonesty”. Depending on the amount that has been defrauded, the offender can be sentenced to a maximum of 10 years imprisonment. Since credit card offences have a very broad definition, you may be charged with fraud if you use your own or other people’s credit cards in a negligent way.

The penalty for credit card offenses depends on the type of offence and the amount that has been defrauded. According to the Criminal Code of Canada, the penalties for theft or forgery of a credit card, use or possession of a stolen or forged credit card or use of a revoked or canceled credit card can result in a 6 month jail term and/or $5,000 fine. For an indictable offense, the maximum penalty is 10 years imprisonment.
