List of Common Criminal Charges
Common criminal charges fall into six categories as listed below. The crown prosecutor can request a summary or hybrid charge, or charge as an indictable offence based on the severity of the offence. Most serious types of crimes are indictable charges and lesser charges are classified as misdemeanors. Upon laying a charge, a criminal record is generated and will prevail until it is expunged. A non-conviction at the courts does not erase the criminal record until steps are taken by the accused or his lawyer to set the records straight.
Driving offences: Dangerous driving, fleeing from police, failure to stop at the scene of accident all have different consequences based on whether a death occurred, injury occurred or no harm occurred. Impaired driving, refusing or failing to provide a breath or blood sample, refusing to comply with demand intended to determine whether a driver was impaired by drugs, impaired driving causing bodily harm or death and driving while disqualified are criminal offenses under the Act.
Crimes of Dishonesty: Fraud or stealing money or property, taking a motor vehicle without the owner’s consent, theft, forgery or using a cancelled/revoked credit card, committing a robbery or extortion, breaking and entering with intent to commit an indictable offence are all classified as criminal offences.
Weapons Offences: Unauthorized possession, careless storage, handling of a firearm or dangerous weapon; or pointing a firearm, carrying a concealed weapon or possession of a restricted weapon with ammunition are all criminal offences.
Crimes involving threat or violence: Murder, homicide, threats to cause death or harm, criminal harassment, assault, assault causing bodily harm or with weapon, assault on a police officer or resisting arrest, aggravated assault, sexual assault, sexual assault with weapon, threat or causing harm are criminal offences in this category.
Drug Offences: Possession, importing, exporting, trafficking or possession for the purpose of trafficking of marijuana, hashish, cocaine, heroine, amphetamines, LSD, mescaline, psilocybin, barbituates or anabolic steroids are all offences under this section. Cultivation of marijuana, production of hashish, cocaine, heroine, amphetamines, LSD, mescaline, psilocybin, barbituates or anabolic steroids are all offences under this section as well.
Offences against administration of law and justice: Public mischief, fail to comply with bail condition, probation order or to attend court, personate a police officer, obstruct police or justice and perjury are criminal offences under this category
Crimes of sexual immorality: Rape, indecent act, keeping a common bawdy house or found in a bawdy house, stopping or impeding traffic (for the purpose of offering, providing, or obtaining sexual services for consideration), communicating to provide sexual services for consideration (in a public place next to school, play ground or daycare), obtaining or advertising sexual service for consideration are all criminal offences under this category.
